These Terms of Service govern your use of ArtistSaver.com and any purchases, communications, products, or services offered through the website.

ArtistSaver.com is operated by Halico Art, LLC. Throughout these Terms, “Artist Saver,” “we,” “us,” and “our” refer to Halico Art, LLC and the Artist Saver brand.

By visiting our website, creating an account, placing an order, subscribing to communications, or otherwise using our services, you agree to these Terms of Service.

1. Online Store Terms

You must be legally capable of entering into a binding agreement to purchase products from our store.

You may not use our products, website, or services for any unlawful or unauthorized purpose.

You may not transmit viruses, malicious code, automated attacks, or other content intended to damage or interfere with our website or services.

We reserve the right to refuse service, cancel transactions, or restrict access when reasonably necessary to protect our customers, business, website, or payment systems.

2. Artist Saver Products

Artist Saver™ is a patent pending paint preservation system designed for painters.

We make reasonable efforts to accurately describe our products, features, dimensions, materials, colors, packaging, pricing, and intended uses.

Product images and colors displayed electronically may vary slightly from the physical product due to manufacturing tolerances, photography, lighting, monitors, and other factors.

Product performance can vary based on environmental conditions, materials used, operating technique, storage conditions, paint formulation, and other factors outside our control. Unless expressly stated in writing, we do not guarantee a specific paint preservation duration.

3. Pricing

All prices are shown in U.S. dollars unless otherwise stated.

Prices, promotional offers, launch pricing, discounts, shipping charges, and availability may change without notice except for orders already accepted by us.

Artist Saver may be offered in limited launch tiers, including a Founding Painter preorder tier, a subsequent launch tier, and a post launch price. The price and shipping terms displayed at the time an eligible order is placed will apply to that order.

Founding Painter pricing and benefits are limited to the quantity stated on the website and are available only while that allocation remains available.

Taxes and shipping charges, when applicable, are calculated or disclosed during checkout.

4. Orders

Submitting an order does not guarantee acceptance.

We reserve the right to refuse or cancel an order for reasons including suspected fraud, payment issues, pricing errors, product availability, shipping restrictions, or other circumstances that reasonably prevent us from fulfilling the order.

If we cancel a paid order, we will issue the appropriate refund.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information.

5. Preorders, Founding Painter Orders, Backorders, and Product Availability

Certain products may be offered before inventory is immediately available.

Artist Saver may be offered as a preorder, backorder, advance purchase, or other future fulfillment purchase. When you place a preorder, you authorize us to charge the amount shown at checkout according to the payment terms presented for that preorder.

The Founding Painter preorder is a limited early adopter offer. Founding Painter preorders are paid in full at the time of purchase and include the shipping and handling benefit stated on the website at the time of purchase.

Founding Painter preorder purchases are final sale for change of mind. They may not be canceled, returned, or refunded because the customer changes their mind, no longer wants the product, or decides not to wait for fulfillment, except where a cancellation, refund, return, or other remedy is required by applicable law.

If Artist Saver arrives with shipping damage to the packaging or product that makes the product unusable or prevents it from functioning as intended, contact us promptly at support@artistsaver.com and provide photographs of the shipping package and affected product. After review and approval of the claim, we will provide a replacement at no additional cost. Cosmetic damage to external shipping packaging alone does not qualify for replacement when the Artist Saver product remains undamaged and fully functional.

Any manufacturing, availability, or shipping date provided for a preorder is an estimate unless expressly stated otherwise. Production schedules, transportation, freight, customs processing, carrier delays, quality inspections, and other circumstances may affect estimated availability dates.

We will comply with applicable laws governing delayed online orders. If we are unable to ship within a promised or legally applicable time period, we may request your consent to a revised shipment date or provide a refund when required by law.

6. Shipping and Delivery

Shipping options, rates, estimated processing times, and estimated delivery times are displayed where available during checkout or in our Shipping Policy.

Founding Painter orders include free shipping and handling when that benefit is stated as part of the Founding Painter offer. Later launch orders and post launch orders may be subject to separate shipping and handling charges as displayed on the website or during checkout.

Delivery dates are estimates and are not guaranteed unless expressly stated.

We are not responsible for delays caused by shipping carriers, weather, natural disasters, customs processing, incorrect customer information, or circumstances outside our reasonable control, subject to any rights or remedies required by applicable law.

Customers are responsible for providing a complete and accurate delivery address.

Our Shipping Policy is incorporated into these Terms by reference.

7. Returns, Replacements, and Refunds

Returns, exchanges, cancellations, damaged products, replacements, and refunds are governed by our published Return and Refund Policy and any product specific terms disclosed before purchase.

Founding Painter preorders are final sale for change of mind as described in Section 5 of these Terms.

If a Founding Painter order arrives with shipping damage that makes the product unusable or prevents it from functioning as intended, an approved claim will be resolved by replacement at no additional cost rather than a return for change of mind.

Nothing in these Terms or our Return and Refund Policy limits any warranty, refund, cancellation, replacement, or other consumer right that cannot legally be waived or excluded.

Customers should review the applicable Return and Refund Policy and preorder terms before purchasing.

8. Intellectual Property

Artist Saver™, the Artist Saver name, logos, product designs, website content, graphics, photography, videos, text, packaging, instructional materials, and other original content are owned by or licensed to Halico Art, LLC unless otherwise stated.

Artist Saver is patent pending.

Nothing contained on this website grants permission to copy, reproduce, manufacture, distribute, sell, modify, publish, or commercially exploit our intellectual property without written authorization.

9. Reviews, Photos, and Customer Content

If you voluntarily submit a review, testimonial, photograph, video, comment, or other content to us, you represent that you have the right to provide that content.

Unless otherwise agreed in writing, you grant Halico Art, LLC a nonexclusive, worldwide, royalty free license to reproduce, publish, display, and use submitted content in connection with Artist Saver marketing, customer education, and business operations.

We will not knowingly attribute a testimonial or endorsement to you in a misleading manner.

10. Email Communications

If you subscribe to Artist Saver marketing emails, you may receive product information, educational content, launch announcements, promotions, special offers, surveys, and other Artist Saver communications.

You may unsubscribe from marketing emails at any time using the unsubscribe link included in our marketing messages.

Unsubscribing from marketing does not prevent us from sending transactional communications related to your orders, account, payments, shipping, returns, customer service requests, or other transactions.

11. SMS Marketing Terms

If you voluntarily opt in to Artist Saver SMS marketing, you consent to receive recurring marketing and promotional text messages from Artist Saver at the mobile number you provide.

Consent to receive SMS marketing messages is not a condition of purchasing any product or service.

Message frequency varies.

Message and data rates may apply depending on your wireless carrier and service plan.

You may opt out of SMS marketing at any time by replying STOP to a marketing text message.

For assistance, reply HELP when available or contact us at support@artistsaver.com.

After opting out, you may receive a final confirmation message indicating that your SMS subscription has been canceled.

Wireless carriers are not responsible for delayed or undelivered messages.

Your use of SMS communications is also subject to our Privacy Policy, which explains how we collect, use, store, and share personal information.

12. Third Party Services

Our store is hosted and supported by third party platforms and service providers, including Shopify and services used for payment processing, email and SMS delivery, fraud prevention, analytics, fulfillment, and shipping.

Your use of certain third party services may also be governed by those providers' separate terms and policies.

We are not responsible for the independent acts, omissions, policies, or availability of third party providers except where applicable law provides otherwise.

13. Prohibited Uses

You may not use our website or services to:

• Violate any applicable law or regulation
• Infringe intellectual property rights
• Submit fraudulent or misleading information
• Attempt unauthorized access to our systems
• Introduce malicious software or code
• Scrape, crawl, or systematically extract website content without authorization
• Interfere with website security or operation
• Impersonate another person or entity
• Engage in fraudulent payment or chargeback activity

We may terminate or restrict access for violations of these Terms.

14. Disclaimer of Warranties

We strive to provide accurate information and reliable products and services.

However, to the fullest extent permitted by applicable law, the website and online services are provided on an “as available” basis.

Nothing in these Terms excludes or limits warranties, guarantees, or consumer rights that cannot legally be excluded.

Any specific written product warranty offered by Artist Saver will be governed by the terms of that warranty.

15. Limitation of Liability

To the fullest extent permitted by law, Halico Art, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from use of the website, inability to use the website, or use of our products.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Halico Art, LLC and its owners, employees, contractors, and service providers from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of our website, violation of these Terms, or infringement of another party's rights.

17. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

18. Changes to These Terms

We may update these Terms periodically to reflect changes in our products, services, business practices, technology, or legal requirements.

The current version will be posted on ArtistSaver.com with the updated revision date.

Your continued use of the website after revised Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

19. Governing Law

These Terms are governed by the laws applicable to Halico Art, LLC, subject to any mandatory consumer protection rights that apply based on the customer's jurisdiction.

Nothing in these Terms is intended to waive rights that cannot legally be waived.
